You attest that you are at least eighteen (18) years of age and that you will not use the Site for any unlawful purpose. Please note: these Terms of Use contain disclaimers and other provisions that limit the liability of Brickell, its subsidiaries, and affiliates, to you.

Material from this or any World Wide Web site owned, operated, licensed, or controlled by Brickell may not be copied or distributed, or republished, posted, uploaded, or transmitted in any way, without the prior written consent of Brickell, except that you may download one (1) copy of the material on one computer for your personal, non-commercial home use only. Brickell operates its business from its headquarters in the United States of America. If any material we provide, or your use of this site, is contrary to the laws of the place from which you access the site, then this site is not intended for your use.
You are responsible for compliance with applicable local laws. Further, if you use or download materials from our site or application, you represent and warrant that you are not located in, or under the control of, any country to which the U.S. has placed an embargo forbidding such access or use.
Only you may use your brickellmensproducts.com user account, and you are responsible for all activity that takes place with your user account. Please keep your user name and password confidential. In such an event, we will change your password and update our records. We reserve the right to terminate any user account in the event you fail to comply with any of these Terms of Use or our Privacy Policy.
Brickell or you may terminate this agreement at any time. You may terminate this agreement by destroying: (a) all materials obtained from the Brickell sites, and (b) all related documentation and all copies and installations. However, if you visit Brickell Sites anew, you will be opting to re-enter into this Terms of Use. Brickell may terminate this agreement immediately without notice if, in its sole judgment, you breach any term or condition of this agreement.
You agree to indemnify, defend and hold harmless Brickell and its officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, and suppliers from and against any and all losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees and court costs, arising or resulting from your use of this Site and any violation of these Terms of Use. If you cause a technical disruption of this Site or the systems transmitting the Site to you or others, you agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from that disruption.
If any part of this Agreement is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

These Mobile Text Terms of Use (“Mobile TOU”) govern your use of the text messaging information and marketing program (the “Program”) provided by Brickell Brands LLC ("Brickell", "us", or "we"). Please read this Mobile TOU carefully. By opting into the Program, you agree to this Mobile TOU, Brickell’s online PRIVACY POLICY, as amended from time to time (collectively, the “Terms”). Your access to, and use of, the Program represents your agreement to these Mobile TOU. IF YOU DO NOT AGREE WITH THESE TERMS, INCLUDING CHANGES THERETO, DO NOT ACCESS, SUBSCRIBE OR USE THE PROGRAM.
Brickell’s Program is an account information and marketing program that sends its users updates on account activity, as well as, but not limited to, great deals and special offers. This information is delivered directly to their mobile phones, via SMS and/or MMS, via equipment that may be an automated dialing or selection system. As a Program member, you may receive account updates, special retailer deals, insider news, access to in-store events (where applicable), ways to enter sweepstakes and instant win games, among other brand-specific communications.
When you provide us with your mobile phone number and enroll in the Text Program, you are expressly agreeing that we may send marketing text messages (including SMS and MMS) to that phone number. You also agree to pay the charges to your wireless bill or to have them deducted from your prepaid balance for this service. You acknowledge that you are thirteen years of age or older and you have the consent of the wireless account holder. We may send recurring automated marketing mobile messages per month. The number of Account Updates & Information messages you receive will depend on your activity with the brand. If you signed up by texting a signup keyword, you will receive a confirmation text message, and you may need to reply as instructed to complete registration. Message and data rates apply. Reply STOP to cancel, HELP for help.
Texts may be sent automatically, including via an automatic telephone dialing system or an automated system that selects numbers. Consent is not required as a condition of purchasing any goods or services. You agree to notify Brickell of any changes to your mobile number and update your subscription with us to reflect this change. Your carrier may prohibit or restrict certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.
To stop receiving promotional or account update text messages from us, simply text STOP to 1-855-397-0294 or reply STOP within 30 days to any text sent by Brickell Men's Products. If you opt-out, you agree to receive a final text message confirming your opt-out.
Note: “STOP” requests are not case sensitive. Alternatively, you can opt-out of receiving texts from Brickell by either sending an email with your mobile phone number to support@brickellmensproducts.com. Please allow up to 10 business days from when the email or physical mail request was received to process your removal.

Brickell Brands LLC reserves the right to modify these Mobile TOU by posting new versions on this website as well as the right to provide additional notices of significant changes. Your continued use of the Program following such changes constitutes your acceptance of those changes.
